▲ TERMS OF USE

Terms of use.

Last updated: 27 April 2026

These provisional terms govern your access to bioom.app and your participation in the Bioom pre-launch waitlist program. By submitting an application you accept these terms. They will be replaced by a formal customer agreement when Bioom launches commercially.

  1. 01Eligibility

The pre-launch program is open to (a) farmers, (b) agricultural advisors, and (c) plant breeders — in each case operating, advising, or conducting research within the European Union or the wider European Economic Area (EU/EEA) during the 2026 growing season. We reserve the right to decline any application without giving a reason.
  2. 02What we provide during pre-launch

If your application is accepted, you receive: one free Bioom soil analysis (DNA + chemistry) on a field of your choosing, access to the interactive web report, and direct contact with the founding team for feedback purposes. The pre-launch service is provided 'as is' without warranties of fitness for any particular purpose. Pre-launch results should not be used as a sole input to high-stakes commercial decisions until the methodology is fully validated for general release.
  3. 03Your commitments

By participating you agree to: provide accurate information in your application; collect samples per the W-pattern protocol we provide; ship samples within the agreed window; and respond to occasional brief feedback requests during the program. You may withdraw at any time without penalty.
  4. 04Data ownership and use

Your soil data (the chemistry values, sequencing reads, and derived indices) belongs to you. You may use it freely. Bioom may use anonymized, aggregated data for product improvement, regional benchmarking, and research publications — never on an individually identifiable basis. You can opt out of aggregated use by emailing privacy@bioom.app. Bioom retains all rights to its analytical methodology, software, reference databases, and report templates.
  5. 05Limitation of liability

To the extent permitted by Dutch law, Bioom's total liability arising out of or relating to this pre-launch program is limited to direct damages and capped at €500 per applicant. Bioom is not liable for indirect damages, lost profits, lost opportunity, or harm caused by relying on pre-launch results without independent verification.
  6. 06Termination

Either party may terminate participation at any time by emailing hello@bioom.app. On termination we will delete your application data within 30 days, overriding the default 24-month retention described in the Privacy Policy. If you would prefer us to retain your application for a future launch, tell us and we will keep it under the standard 24-month timeline.
  7. 07Governing law

These terms are governed by Dutch law. Disputes will be resolved by the competent court in the district of Gelderland (Arnhem). Nothing in these terms excludes statutory rights you may have as a consumer or business under Dutch or EU law.
